The Site is an e-commerce platform that allows internet users to purchase clothing and fashion accessories listed for sale on the Site.

These general terms and conditions are intended to define the terms and conditions of online sales and the delivery of Products, as well as to establish the rights and obligations of the parties in this context.

The applicable version of the general terms and conditions is the one available online on the Site at the date of the Buyer’s order.

These general terms and conditions of sale take precedence over any other general or specific conditions not expressly agreed upon by Damage Label.

They may be supplemented, as necessary, by specific terms of use applicable to certain Products or services offered on the Site, which will supplement these general terms and conditions and, in the event of any conflict, will prevail over them.

Legal Capacity and Acceptance of the General Terms

Legal Capacity

• Any individual who has the full legal capacity to engage under these general terms and conditions. Individuals who do not have full legal capacity may only access the Site with the consent of their legal representative.
• Any legal entity acting through an individual who has the legal capacity to contract on behalf of and in the name of the legal entity.

Acceptance of the General Terms

The Buyer’s acceptance of these general terms and conditions is evidenced by a checkbox in the order form. This acceptance is full and complete. Any conditional acceptance is considered null and void.

Buyers who do not agree to be bound by these general terms and conditions should not place orders on the Site.

Registration on the Site

Damage industry recommends that Buyers register directly on the Site before placing an order. However, it is possible to place an order without creating an account on the Site by using the "Guest" status. The registration process is detailed below to facilitate online ordering.

Buyers may create a customer account to place orders on the Site by completing the form provided on the Site. All required information must be provided. Incomplete registrations will not be validated.

Registration automatically creates an account in the name of the Buyer, which allows them to manage their purchases in the form and according to the technical means that Damage Label deems most appropriate.

The Buyer guarantees that all information provided during registration is accurate, up-to-date, and truthful and is not misleading in any way.

Buyers agree to update this information in their Account in case of any changes (such as changes of address), ensuring it remains accurate and relevant.

The Buyer is informed and agrees that the information entered for the creation or updating of their Account constitutes proof of their identity. The information entered by the Buyer is binding upon validation.

The Buyer may access their Account at any time after identifying themselves with their login credentials and password.

The Buyer agrees to use their Account personally and not to allow any third party to use it on their behalf or for their account, except at their own responsibility.

They are similarly responsible for maintaining the confidentiality of their login credentials and password; any access to the Site using them is presumed to be by the Buyer. The Buyer must immediately contact Damage Industry using the contact details provided in the "Seller’s Identity and Contact Information" section of these terms if they notice that their Account has been used without their knowledge. They acknowledge Damage Label's right to take appropriate measures in such cases.

Product Features

Stock Availability:

Before placing an order online, Buyers can review the features of each Product they wish to order on the Site.

Products are offered for online sale while stocks last.

The photographs and descriptions of the Products offered for sale online are as accurate as possible. However, they are only binding on Damage Industry to the extent of what is explicitly stated. The Buyer is informed and accepts that certain Product features, particularly color, may not exactly match the photographs displayed on the Site due to technical limitations.

Estimated Delivery Time

For standard products, the estimated delivery time is between 8 and 15 days from the date of order processing.

Return Policy

Buyers have the right to return products within 14 days of delivery, starting from the day the merchandise is received by the customer. If you wish to return a product, please send it back to the return address listed below. Products must be returned in their original packaging, unworn (except for trying on), and unwashed. Any deterioration of the product during the return process will be the buyer's responsibility. Refunds will be processed within 14 days of receiving the returned merchandise.
